Aint The Rule Of Law A Bitch 1

I AM currently almost half way through my LLM Programme in the area of ‘International Law And Diplomacy’. Quite an interesting area of law, you should know. And I love the most the aspect of it called ‘International Humanitarian Law’ -otherwise referred to as the ‘Law of  Conflict’. Or the ‘Law of War’. Yes, you heard right; the ‘law of war’! Rule of law As if war itself is a legal necessity. You wonder why the ‘rule of law’ is so ‘bitchy’ it superintends even over such obnoxious blood-letting and life-wasting phenomenon called war. But soon you’ll see how cowardly even the ‘rule of law’ is, that although it purports to regulate such undesirable phenomenon, yet as soon as hostilities commence, even the ‘rule of law’ spinelessly comes down from its high reverent horse, covers its f...

Nobel laureate, Wole Soyinka, has criticised President Muhammadu Buhari over his comments at the opening ceremony of the Nigerian Bar Association (NBA) conference last Sunday. In a statement Thursday, Mr Soyinka mocked the president by saying Mr Buhari had obviously given a deep thought to his travails under a military dictatorship and concluded that his incarceration at that time was also in the ‘national interest.’ . Mr Buhari was imprisoned for years by the Ibrahim Babangida regime after his military dictatorship was overthrown in 1985. Since returning to power in 2015, Mr Buhari’s government has held some Nigerians for years without trial. High profile detainees have been denied freedom despite court orders. . “Here we go again,” Mr Soyinka said in the statement he titled...

Rule Of Law And Security (1) By Femi Falana

From 1984-1999, I was subjected to constant harassment by the security and intelligence community in Nigeria. Not for posing any threat to national security or for contributing to the economic adversity of the country. But for teaming up with other patriotic forces to challenge  unbridled corruption, unabashed executive lawlessness, gross human rights abuse and other illegal activities which subverted national  security and endangered the welfare of the people of Nigeria under successive military regimes. Owing to the refusal of the civilian wing of the political class to demilitarize  the  polity there has been unsettled debate over the primacy of national security  over the rule of law. Majority of political office holders in the country are not committed to the observance of th...

It’s Time President Buhari Respected Court Judgements

The failure of the Federal Government to obey successive court orders granting bail to a former National Security Adviser to President Goodluck Jonathan, Col. Sambo Dasuki (retd.), raises serious issues of constitutionalism, the rule of law and Nigeria’s obvious descent into dictatorship. For the avoidance of doubt, Nigerians need to understand that dictatorship starts slowly, builds up incrementally and then goes full blast to a crescendo where everything and everyone will be fair game. It is evident that Nigeria is going through perilous times when the rule of law is about to be subsumed by the rule of the whims and caprices of individuals. This discourse analyses the implications of the continued disobedience of court orders, especially the latest court order on Dasuki, by the Buhari...
